Personal Files and Downloads Terms of Use and License

Thank you for using my files! I want to provide a fair and fun experience for you (the Licensee). Details below- but as an overview, you can use this file for personal use, but please help me grow by giving me credit if you post your work, and don’t help others steal it/ distribute it to others, even if you change part of it. If you want to share a download or file, just send people to this site and they can download their own copy!

If you want to manufacture or sell anything I have designed or written (or just parts of it) – please contact me and we will make an arrangement for payment and set up an agreement for commercial use. If you purchased a file that already includes a limited commercial license, you are in the wrong place and should read the Limited Commercial Terms of Use and License.

I am sharing files and information, but I am not responsible for errors, accidents, or misuse in any way. I can’t possibly cover every aspect of safety or tool operation, or know what people will do with the things I share, so please follow the operating standards for your equipment.

Here are the nitty-gritty details:

By using or accessing files or downloads created by Elizabeth Light and Dark, also called Elizabeth Light & Dark, or by the owners, creators, or employees thereof the Licensee acknowledges and agrees to be bound by the terms and conditions of this agreement.

This file remains the property of Elizabeth Light and Dark. All rights, including copyright and intellectual property rights, in and to the Work, remain the exclusive property of the Licensor. This Agreement does not transfer any ownership of the Work to the Licensee. It is provided to you for your own personal use.

Personal Use: You agree that you will not copy, reproduce, alter, modify, or create derivative works, except for your own personal, non-commercial use. Modified or derivative works using files or downloads provided by the Licensor must remain for your own personal use.

You CAN post non-digital creations made with this file onto public sites or your personal blog, or submit creations to print or online publications provided that you credit Elizabeth Light and Dark. You CAN modify the files for personal use. You CAN make items from my files for family and friends.

for the purpose of this license, non-digital creations means physical, tangible items you made using all or part of files or downloads.

No Redistribution: You may not reproduce, repackage, remix, or redistribute the contents of pages, downloads, or files, in whole or part, alone or in combination for any reason, either for free or for payment. Likewise, do not post, send, share, or sell screenshots or other representations of the files, downloads, or pages without explicit permission of Elizabeth Light and Dark. I am a small independant designer, and unfortunately it is too easy for people to steal designs from screen shots. 🙁

Limited Commercial Use: If you purchased a file from Elizabeth Light & Dark that explicitly states that a limited commercial license is included you are bound by, and granted privileges by, the Purchased Commercial Files and Downloads Terms of Use and not by this document, which is the Personal Files and Downloads Terms of Use and License.

The Licensor is in no way responsible for loss, damage, accidents or injury resulting from viewing, downloading, or using files, downloads, pages, or posts. Likewise, the Licensor is in not responsible in anyway for actions taken by the Licensee, even if the Licensee is acting on information presented or created by the Licensor.

All materials are presented as ‘use at your own risk’. Making things, using tools, materials, and supplies exposes you to danger. The Licensor can not provide nor presents themselves as providing, complete and accurate information for every tool, material, or supply. Any information or instruction presented by the Licensor is superseded by the instructions and standards pertaining to the tools, materials, or supplies the Licensee uses.

It is incumbent upon the Licensee to take responsibility for verifying information, ensuring that information is applicable, up to date, and complete as applies to their unique situation. The Licensee is wholly responsible for knowing and enacting safe operation standards for equipment, materials, and supplies they use. It is up to the Licensee to take appropriate actions to ensure their safety, the safety of others, and the safety and condition of tools, equipment, materials, places of operation, and all other property.

The Licensor, it’s agents, owners, and employees are not liable for any direct or indirect, health, economic, special or consequential loss or damage of any nature, without limitation, including non tangible losses and secondary losses or damage.

Modification of Terms: Elizabeth Light and Dark shall have the right to modify the terms of this agreement at any time, which modification shall be effective immediately and shall replace all prior agreements.
